We highly recommend that you build your business professionally, legally, ethically, and morally correctly. This is absolutely your best defense if you are investigated or charged with practicing anything without a license -- because if you do these things, it's easy to prove you are innocent.

If You Are Being Investigated
We will negotiate to have the investigation closed without any charges being filed against you. In our experience if you negotiate in good faith at this stage of the procedures there's a very good chance charges will never be filed against you. These negotiations usually mean you need to do something to satisfy the government investigators. That means there are things you can do to help your own cause. It also means that you meet your legal obligations.
If You Are Charged and Innocent
We will negotiate in good faith to have all charges against you dismissed with prejudice so that agency or board cannot harass you in the future. The truth is we rarely get charges dismissed with prejudice. They are usually dismissed without prejudice. This means the charges can be reinstated if you violate the agreement you make with the government.
Most licensing boards will demand you agree to these three things:
- You agree to remain properly certified in your profession by an independent and fully accredited certification board
- You agree to use an informed consent form approved by the board or agency investigating you
- You agree to refer your clients who need professional help to the appropriate licensed professionals in your jurisdiction -- federal, state, provincial or locally -- approved by the license board or government agency investigating you.
In our experience if you do these things as you build your practice you can usually avoid any conflicts with any licensing board or government agency. But if wait until you are formally charged, it's normally too late to save your business. The downside is also attorney fees and court costs.
We will attempt to identify the perpetrators of your investigation and report them to the appropriate enforcement agencies for making false accusations against you. We will enlist the services of any experts required to exonerate you. We want to prove you're innocent as much as you do.
If You Are Charged and Guilty
We will refer you to a qualified attorney experienced with negotiating situations like yours with licensing boards. This is an expensive undertaking, but the downside is incarceration and a fine.
